Terms & Conditions
1. Contract and Acceptance
By making the initial payment, the Client confirms acceptance of these General Terms and Conditions, forming a binding agreement with the Charter Company. The Client accepts these terms on behalf of all passengers listed in the crew manifest.
2. Rental Price and Payment Terms
- Included in the Price:
- Use of the vessel with standard equipment.
- Base marina fees for embarkation and disembarkation.
- Insurance for the vessel (liability and hull coverage).
- Excluded from the Price:
- Fuel, mooring fees outside the base marina, food, and beverages.
- Additional crew services (e.g., skipper, hostess, chef).
- Costs of optional extras, such as water toys or excursions.
- Payment Schedule:
- 50% of the total charter fee is due within 7 days of booking confirmation.
- The remaining 50% must be paid no later than 30 days before the charter start date.
- Failure to adhere to this payment schedule may result in cancellation without refund.
3. Security Deposit
Before taking possession of the vessel, the Client must provide a refundable security deposit:
- Purpose: Covers potential damages, loss of equipment, or non-compliance with contractual obligations.
- Payment Method: Can be made in cash or as a credit card hold, to be refunded after a satisfactory inspection at check-out.
- Additional Terms:
- A double deposit may apply for regattas or high-risk charters.
- Any damages exceeding the deposit amount must be settled directly by the Client.
4. Check-In Process
- Timing: Embarkation usually starts at 17:00 (5 PM) on the first charter day.
- Procedures:
- A joint inspection will be conducted with the Client to verify the condition, inventory, and fuel/water levels.
- The Client must present valid navigation licenses and a completed crew list during the check-in.
- The Charter Company will provide an orientation covering vessel operation, safety protocols, and navigation rules.
5. Check-Out Process
- Timing: The vessel must be returned:
- To the designated marina on the evening before the final day ( usually by 18:00).
- Fully vacated by 09:00 on the last day.
- Procedures:
- A final inspection will be conducted to assess the vessel’s condition, inventory, and fuel levels.
- The Client must return the vessel clean, remove all waste, and ensure fuel tanks are full.
- Late Return Penalties: Delayed returns will incur a penalty of 300% of the daily charter rate for each overdue day, charged hourly.
6. Crew and Additional Services
- Professional Crew:
- The Captain has full authority over sailing decisions to ensure the safety of passengers and the vessel.
- Any inappropriate behaviour by the Client or their party may result in the termination of the contract without refund.
- Crew Provisioning:
- The Client is responsible for providing meals and beverages for the crew unless otherwise agreed in writing.
- Optional Services:
- Additional crew or water toys (e.g., jet skis, seabobs) must be booked at least 14 days in advance.
7. Client Responsibilities
The Client must:
- Operate the vessel responsibly, adhering to Croatian maritime laws and navigation rules.
- Use the vessel for recreational purposes only, without sub-chartering or engaging in commercial activities.
- Limit onboard passengers to those listed on the crew manifest.
- Notify the Charter Company immediately in case of accidents, damages, or equipment failures.
- Follow the Captain’s instructions on safety and operational matters.
8. Charter Company Responsibilities
The Charter Company ensures:
- Delivery of a seaworthy vessel, in clean and fully operational condition, as per the inventory list.
- Support for technical or operational issues during the charter, with repairs completed within 24 hours if feasible.
- Provision of a replacement vessel of equal value or a proportional refund if the original vessel is unavailable due to unforeseen circumstances.
9. Cancellations and Refunds
- Client Cancellations:
- Up to 61 days before the charter: 50% refund.
- Less than 30 days before the charter: No refund.
- Charter Company Cancellations:
- A full refund or a comparable replacement vessel will be offered in case of unforeseen unavailability.
10. Force Majeure
- In the event of force majeure (e.g., extreme weather, natural disasters, or government restrictions), the Charter Company:
- Can issue a credit valid for up to 12 months for a future charter.
- Will not provide refunds for cancellations caused by force majeure events.
11. Insurance
- Coverage: The vessel is insured against third-party liability and hull damage exceeding the deposit amount.
- Exclusions:
- Damages caused by negligence or misuse.
- Loss of personal belongings or equipment, unless specified in the insurance policy.
- Damages to sails, propellers, or underwater parts caused by negligence.
12. Complaints
All complaints must be submitted in writing within 14 days of the charter’s end to to charter company and the DB007 agency. Complaints received after this period will not be considered.
13. Disputes
Any disputes arising from the charter agreement shall be resolved under Croatian law in the competent court of jurisdiction.
